Experience

Overview

R.A.’s practice focuses on advising condominium and homeowners associations on matters of compliance with their governing documents, and on collection of past due assessments.  R.A. has successfully obtained orders requiring homeowners to make repairs to houses, requiring unit owners to remove nuisance animals from condominiums, as well as obtaining delinquent assessments through remedies such as garnishments. Prior to joining Rees Broome, R.A. served as counsel to large institutional lenders in foreclosure related proceedings in both the state and bankruptcy courts.  He was responsible for advising clients on the effects of various bankruptcy proceedings on their portfolios of accounts as well as representing clients in matters ranging from simple stay matters to more complex claim objections and chapter 11 proceedings.  Earlier in his career he was lead Virginia counsel for a large national debt purchaser, involving not only litigating the collection of accounts, but advising them on matters of compliance with state and federal regulations as well.  R.A. has also been on the other side of the aisle, representing consumers before both state courts and bankruptcy courts.

In addition, R.A. has a depth of experience with:

  • Amending associations Declarations, Bylaws, and Articles of Incorporation.
  • Drafting and amending policy resolutions.
  • Collection of assessments by filing foreclosure actions.
  • Drafting and reviewing management and service provider contracts.
