R.A. Hurley focuses his practice on representing condominium and homeowners associations in matters involving compliance with governing documents and the collection of delinquent assessments. He advises associations on a broad range of operational and enforcement matters and has successfully obtained court orders requiring homeowners to make necessary property repairs, requiring unit owners to remove nuisance animals from condominiums, and enforcing the collection of delinquent assessments through remedies such as garnishments and foreclosure actions.

Prior to joining Rees Broome, R.A. represented large institutional lenders in foreclosure-related proceedings before state and bankruptcy courts. In that role, he advised clients on the impact of various bankruptcy proceedings on their portfolios of accounts and represented them in matters ranging from routine stay issues to complex claim objections and Chapter 11 proceedings.

Earlier in his career, R.A. served as Virginia counsel for a large national debt purchaser. His responsibilities included litigating the collection of accounts and advising the company on compliance with applicable state and federal laws and regulations. He has also represented consumers in both state and bankruptcy courts, giving him valuable perspective on the interests and legal considerations of all parties involved in collection and bankruptcy matters.

R.A. has extensive experience in the following areas:

  • Amending association Declarations, Bylaws, and Articles of Incorporation.
  • Drafting and amending association policy resolutions.
  • Collecting delinquent assessments, including through foreclosure actions and other legal remedies.
  • Drafting and reviewing management agreements and service provider contracts.
  • Advising associations on compliance with governing documents and applicable legal requirements.
