Community associations are facing increased costs for complying with the cleaning and social distancing protocols required to reopen offices, common areas, and amenities. These increases get passed on to Owners who may also be facing reduced income. While assessments remain vital to associations, boards are faced with deciding how to best collect assessments during this unprecedented time.

As stewards of association common areas and resources, Boards and managers often face various questions involving trees owned by the Association. As such, a general familiarity with your jurisdiction’s tree law and how your responsibility and liability have grown is important to properly guiding your association through such issues.

Neighbor to neighbor disputes seem to be at an all-time high right now.  Many times, the neighbors are trying to bring the Association in to these battles.  In order to best utilize the Association’s assets, Boards and managers must recognize when it is appropriate for the Association to engage, and when to stay out of the conflict.

During its 2020 legislative session, the General Assembly approved a number of bills that create changes to the Property Owners’ Association Act (“POAA”), the Condominium Act and the Code of Virginia.  The legislation addressed in this newsletter will take effect on July 1, 2020, unless otherwise noted below.
