Pat’s practice has focused on Northern Virginia’s commercial and residential real estate industry for the past 25 years. He has represented developers, lenders, community associations, homeowners and corporations in all aspects of the finance, development and ultimate use of real property. Typical issues for which Pat has provided representation include:

Representing developers and business through all aspects of the land development process, including acquisition, zoning, special use permitting, subdivision, site plan, drafting declarations, by-laws, restrictive covenants, architectural guidelines, rules and regulations. He also handles post-development issues such as plan amendments, zoning interpretations and zoning administrator appeals to the Board of Zoning Appeals.

Representing a non-profit entity through the acquisition of a large tract of land for use as a public recreation facility. Critical issues included working with elected government officials to gain political support and develop acceptable project conditions, negotiating the terms and conditions of a Virginia Conservation Easement, assisting in the review of subdivision plats and plans, drafting subdivision and restrictive covenant documentation and drafting and negotiating the final contract of sale.

Successfully representing a group of homeowners objecting to a proposed commercial development abutting their community. The representation included requesting a zoning administrator interpretation, appealing the decision to the Board of Zoning Appeals, assisting in organizing the neighbors in preparation for the appeal hearing and advocating on behalf of the neighborhood at the appeal hearing.

Representing an 84 unit residential cooperative in connection with developing and implementing the processes and procedures required to convert this cooperative, which was then subject to HUD governance, into a fee-simple homeowners’ association subject to the Virginia Property Owners Association Act. Pat participated in all aspects of this conversion including preparing documentation, making presentations to community members, assisting in the selection of necessary professionals and meeting with each cooperative member to accomplish execution of the required contracts.

Representing numerous community associations in connection with maintaining a proper governance structure, adhering to the governing documents when resolving member disputes and complying with state and local governmental regulations. Pat has successfully resolved election disputes and covenant violations. He has advocated on behalf of community associations attempting to modify proffers and development conditions and he has obtained favorable proffer interpretations allowing a community to implement changes to its property. Pat has also represented community associations in connection with issues involving the original developer. Most recently Pat assisted the Board of a large planned unit development in ensuring the developer’s compliance with all proffers, including construction of community facilities.
